Description of Service
myresort.io provides a cloud-based resort management platform including property management, booking management, channel management, and related hospitality software solutions for resorts and hotels in India.
Account Registration
To use our Service, you must:
- Be at least 18 years old
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Be authorized to act on behalf of your organization
- Notify us immediately of any unauthorized access
Subscription and Payment
Pricing
Subscription fees are based on your selected plan and any add-on modules. Prices are listed on our website and may be updated with 30 days notice.
Billing
Subscriptions are billed annually in advance. All fees are non-refundable except as expressly stated in these Terms. Payments are processed in Indian Rupees (INR).
Taxes
All prices are exclusive of applicable taxes (including GST). You are responsible for all taxes associated with your subscription.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights
- Transmit malicious code or interfere with the Service
- Attempt to gain unauthorized access to systems
- Resell or redistribute the Service without authorization
- Use the Service to harm or harass others
Your Data
You retain ownership of all data you input into the Service. By using the Service, you grant us a license to use this data to provide and improve the Service. You are responsible for the accuracy and legality of your data.
Guest Data
You are responsible for obtaining appropriate consent from your guests for collecting and processing their personal information. You must comply with applicable data protection laws in India.
Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted access. We may perform maintenance with advance notice when possible. We are not liable for service interruptions beyond our control.
Intellectual Property
The Service, including its design, features, and content, is owned by myresort.io and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.
Limitation of Liability
To the maximum extent permitted by law, myresort.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless myresort.io from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
Termination
Either party may terminate the subscription with 30 days written notice. We may immediately terminate your access for violation of these Terms. Upon termination, your data will be available for export for 30 days.
Governing Law
These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Kolkata, West Bengal.
Changes to Terms
We may modify these Terms at any time. Material changes will be communicated with 30 days notice. Continued use after changes constitutes acceptance.
